In the condition that many provinces and cities across the country implement social distancing to prevent the COVID-19 epidemic, the Vietnam Engineering Consultant Association has successfully organized an online training course on the Zoom Webinar platform on Conditions of Contract for Plant and Design – Build (FIDIC Yellow Book) version 2017. This is a type of contract published by FIDIC in 2017, on the basis of updating the 1999 Yellow Book version, which is deemed appropriate with EPC contract according to Vietnam’s regulations. Nearly 50 participants inside and outside the Association across the country attended the 2-day training course (August 19 and 20, 2021), exchanging and giving different situations. The contents of the training course were presented by the President of the VECAS, Nguyen Thi Duyen (lecturer), notes and emphasized the issues that need to be when applying the FIDIC contract forms to be used in accordance with the current regulations of Vietnam. The training course not only focused on the general structure of FIDIC contract templates, the principles of effective application and the focus on the General Conditions of the Yellow Book 2017, dispute adjudication mechanism, guidelines of FIDIC when drafting Particular Conditions, applying BIM … but also mentioning the latest amendments and supplements to EPC contracts according to Vietnam’s regulations in legal regulations: Law No. 62/2020 /QH14 amending and supplementing a number of articles of the Law on Construction No. 50/2014/QH13; Decree No. 15/2021/ND-CP of the Government detailing some contents of construction investment project management; Decree 06/2021/ND-CP of the Government detailing a number of contents on quality management, construction and maintenance of construction Works; Decree 50/2021/ND-CP of the Government amending and supplementing a number of articles Decree No. 37/2015/ND-CP dated April 22, 2015 detailing construction contracts.

Practical case studies on FIDIC multi-contract management with the same project, practical examples court award of a foreign court related to the dispute adjudications mechanism of FIDIC contract presented by the lecturer helped the trainees better understand the Engineer’s decision-making process, the Parties’ Claim process, and the implementation of the dispute adjudication mechanism through the Dispute Adjudication Board.

Participants also studied FIDIC COVID – 19 Guidance Memorandum to Users of FIDIC standard forms of Works Contract (April 2020), how to apply the terms of different FIDIC contract forms when dealing with issues related to the COVID-19 pandemic.

During the training, many questions and practical situations raised by the trainees were discussed and answered satisfactorily by the Lecturer. After the course, the participants will be granted a certificate of completion of the course in Vietnamese – English issued by the Vietnam Engineering Consultant Association.
