International Conference with the topic “Construction Contract Dispute Resolution Procedures from Dispute Adjudication Board (DAB) to arbitration and practical lessons” in Hanoi coordinated by Vietnam Engineering Consultant Association in collaboration with international partners, YKVN (Singapore), Exponent (Singapore) and ICC Arbitration &ADR  (Singapore) held on the afternoon of August 18, 2023.

The conference received the attention of nearly 160 delegates, coming from state management agencies in construction and bidding; international financial institutions such as WB, JICA…; domestic and foreign investors, consultants and construction contractors; arbitration bodies and national and international lawyers.

With the presentation of four speakers who are experts in the field of construction and legal in Vietnam and internationally, experts who are knowledgeable about FIDIC contracts, Vietnamese laws, experience through practical International experience has shared knowledge, key issues of the contract management mechanism and dispute resolution through the DAB of FIDIC construction contracts, issues to be concerned with when the contract has a DAB… It is necessary to properly understand the multi-tier contract management mechanism in FIDIC’s contract templates, in which it is necessary to distinguish the role of the Engineer or the Employer’s Representative (depending on the contract form) for the Claims settlement and disputes settlement by DAB

The speakers also directly answered questions from delegates from state management agencies, international financial institutions, investors, project managers, contractors, consultants, law firms. … relating to the construction contract dispute resolution mechanism through the Dispute Adjudication Board or the Dispute Avoidance/Adjudication Board (DAB/DAAB).

The speakers all think that when the parties sign a construction contract, no one wants to create a dispute. When applying the FIDIC contract forms with a DAB, disputes that have not been resolved by the DAB or where the DAB’s decision is not accepted by a party will be finally resolved by arbitration. In practice, there have been many international construction arbitrations (including ICC arbitrations) after the parties attempted to resolve the dispute through the DAB
